PRODUCT RETURN AND RIGHT OF WITHDRAWAL POLICY

1. Legal right of withdrawal

If you enter into a distance contract through the atelierrebul.ro website as an individual consumer, you have the right to withdraw from the contract within 14 calendar days without stating a reason.

The withdrawal period expires 14 calendar days after the day on which you or a third party designated by you, other than the carrier, takes physical possession of the products.

If you ordered several products in a single order that are delivered separately, the withdrawal period begins on the day on which you or a third party designated by you, other than the carrier, takes physical possession of the last product.

The right of withdrawal is regulated by Government Emergency Ordinance no. 34/2014 on consumer rights.

2. Exercising the right of withdrawal

To exercise your right of withdrawal, you must inform us of your decision to withdraw from the contract by making an unambiguous statement.

You can submit the withdrawal request through one of the following methods:

• via the electronic withdrawal function available on the website, by accessing the “Right of Withdrawal” link in the website footer or the order page in your customer account;

• by email at contact@atelierrebul.ro;

• by any other clear and unambiguous statement expressing your decision to withdraw from the contract.

The electronic withdrawal function allows you to submit the withdrawal request online. During this process, you may be asked to confirm the withdrawal request through a separate, clear, and unambiguous confirmation step.

After submitting the request through the electronic withdrawal function, you will receive, without undue delay, a confirmation of receipt on a durable medium, usually by email. The confirmation will include the content of the withdrawal request, as well as the date and time of its submission.

The withdrawal statement must contain at least the following information:

• the order number;

• the customer's full name;

• the email address used when placing the order;

• the product or products for which the withdrawal is requested;

• the electronic means by which you wish to receive the confirmation of the request, usually the email address.

The use of a standard form is not mandatory. Any clear and unambiguous statement is sufficient, provided it is submitted before the legal withdrawal period expires.

3. General return conditions

Products can be returned within the legal period of 14 calendar days, without penalties, in compliance with the legal provisions and this policy.

Products must be returned in the same condition in which they were delivered, without being used beyond what is necessary to determine their nature, characteristics, and operation, respectively, a check similar to that which could be carried out in a physical store.

The customer is responsible for the reduction in the value of the products resulting from handling them in a manner other than what is necessary to determine the nature, characteristics, and operation of the products.

3.1 Specific conditions for reed diffusers

Inserting the reeds into the scented liquid and using the diffuser to scent a space generally exceeds the handling necessary to check the product's characteristics.

Putting it into operation may cause irreversible changes to the product, including:

• Impregnation of the reeds;

• Evaporation of the scented liquid;

• Inability to subsequently market the product as new.

In the event of returning a diffuser used in this manner, Atelier Rebul will individually assess the reduction in the value of the product, in accordance with Art. 14, para. (3) of GEO no. 34/2014.

The reduction in value may include objectively justified commercial loss. If it is demonstrated that the product no longer has recoverable commercial value due to use, the depreciation may be up to 100% of its price.

The reduction in refund is not automatically applied, but rather depends on the actual condition of the product and the demonstrated depreciation.

This provision does not restrict the legal right of withdrawal nor does it affect the consumer's rights in the case of non-conforming products.

3.2. Return conditions for promotional gifts

As part of certain promotional campaigns, Atelier Rebul may offer free products upon reaching a minimum order value or purchasing eligible products.

The provision of these gifts is subject to compliance with the criteria communicated in the campaign regulations and the promotional offer.

Full return of the order

In the event of a full return of the products purchased as part of such a promotion, the customer is obliged to also return the products received as gifts, in accordance with the campaign conditions accepted at the time of purchase.

Partial return of the order

In the event of a partial return:

• If the value of the products kept by the customer falls below the minimum threshold required to grant the gift or if the other eligibility conditions are no longer met, the promotional gift must be returned together with the products for which the return is requested.

• If, following the partial return, the eligibility conditions remain met, the customer may keep the promotional gift.

Conditions regarding the return of promotional gifts

Promotional gifts that must be returned will be returned under the conditions provided by the campaign regulations and applicable legislation.

In the event that a promotional gift is not returned or has been used, the situation will be assessed individually, taking into account:

• The conditions communicated before purchase;

• The value and condition of the product;

• The consumer's legal rights.

Any amounts owed will be determined only if there is a valid contractual and legal basis, without the application of automatic or disproportionate penalties.

These provisions do not limit the legal right of withdrawal nor the consumer's rights regarding non-conforming products.

4. Exceptions to the right of withdrawal for cosmetic and personal care products

According to Art. 16, lit. e of GEO no. 34/2014, the right of withdrawal does not apply in the case of the supply of sealed products that cannot be returned for health protection or hygiene reasons and which have been unsealed by the consumer after delivery.

This category may include, but is not limited to:

• cosmetic products;

• perfumes;

• creams;

• shower gels;

• personal care products;

• products intended for application on the skin, hair, or body.

Therefore, products delivered sealed, which have been unsealed by the consumer after delivery and which cannot be returned for hygiene or health protection reasons, cannot be subject to the right of withdrawal.

Products returned sealed, without traces of unsealing, use, or damage, may be subject to the right of withdrawal, in compliance with the conditions provided in this policy.

5. Return costs

The direct costs of returning the products are borne by the customer.

The return of products is carried out through a courier service chosen by the customer. The products must be packaged properly so that they are protected during transport.

7. Refunds

In the event of the lawful exercise of the right of withdrawal, we will refund the amounts paid for the returned products without undue delay and, in any case, no later than 14 calendar days from the date on which we are informed of the withdrawal decision.

In the event of a withdrawal from the contract for the entire order, the refund will also include the standard delivery costs, if they were paid by the customer. We are not obliged to refund the additional costs resulting from the customer's choice of a delivery method other than the standard delivery offered by us.

We reserve the right to postpone the refund until the date of receipt of the returned products or until the receipt of proof of their shipment, whichever occurs first.

The refund will be made using the same payment method used for the initial transaction, except in the case where you have expressly agreed to another method of refund.

Products purchased using an Atelier Rebul Gift Card benefit from the same legal rights of withdrawal as products paid for through other payment methods.

In the event of a return, the amount paid by Gift Card will be refunded by recrediting it or by issuing a new Gift Card with an equivalent value and terms of use that do not disadvantage the consumer.

In the case of orders partially paid with a Gift Card and partially through another payment method, the refund will be carried out according to the payment methods initially used.

Any other method of refund may be used with the express agreement of the consumer, without additional costs for them.

8. Improperly returned products and reduction in value

In accordance with Art. 14, para. (3) of GEO no. 34/2014, the consumer is responsible for the reduction in the value of the products resulting from handling them in a manner other than what is necessary to determine their nature, characteristics, and operation.

Upon receipt of returns, Atelier Rebul may check the condition of the products, including:

• the existence of traces of actual use;

• the quantity of product consumed or missing;

• damage to the product or its components;

• the condition of the packaging, to the extent that it objectively affects the value of the product;

• the possibility of subsequent marketing and the remaining commercial value.

In the event that a depreciation caused by excessive handling is found, the refunded value may be reduced proportionally to the actual loss of value, objectively justified.

In situations where the product has completely lost its commercial value as a result of use beyond the limits necessary to check its characteristics, the reduction may be up to 100% of the product's value, provided that this loss is demonstrated.

Simply opening the packaging does not automatically determine a reduction in the refund or the loss of the right of withdrawal.

In the case of products that fall under the legal exceptions provided in Art. 16 of GEO no. 34/2014, the right of withdrawal may be excluded under the conditions expressly provided by law.

Any reduction in the refund will be communicated to the consumer together with its justification.

These provisions do not affect the consumer's legal rights in the case of non-conforming products.

9. Right of withdrawal for legal entities

The legal right of withdrawal applies exclusively to individual consumers.

Legal entities do not benefit from the right of withdrawal provided by GEO no. 34/2014, except in situations where Atelier Rebul expressly and specifically accepts a return request.
