TERMS AND CONDITIONS FOR PURCHASING AND USING THE ATELIERREBUL.RO WEBSITE

  1. Introduction

This document sets out the terms and conditions governing the use of the atelierrebul.ro website, as well as the placement of orders and the purchase of products sold through it, hereinafter referred to as the “Terms”.

The atelierrebul.ro website is operated by BOLD DESIGN COLLECTION S.R.L., as the seller of the products sold through it.

Using the website, creating an account and/or placing an order implies full and unconditional acceptance of this document, as well as the related documents available on the website, namely the Privacy Policy, Cookie Policy, Product Return and Exercise of the Right of Withdrawal Policy, and Delivery Policy.

The Terms may be amended periodically. The applicable version is the one displayed on the website at the time of using the website or placing the order.

  1. Definitions

For the purposes of this document, the following terms have the following meanings:

Seller: BOLD DESIGN COLLECTION S.R.L., the company that sells products through the atelierrebul.ro website.

Customer or User: any natural or legal person who accesses the website, creates an account, places an order, or uses the services available on the website.

Consumer: any natural person or group of natural persons formed into associations, acting for purposes outside their commercial, industrial, production, artisanal, or liberal activity.

Contract: the distance-selling contract concluded between the Seller and the Customer through the atelierrebul.ro website.

Order: the request submitted by the Customer through the website, by which the Customer expresses their intention to purchase one or more products.

Product: any good displayed on the website and available for sale, subject to stock availability.

  1. Use of the website

The User undertakes to use the website exclusively for legitimate purposes, namely for information, browsing products, creating an account, and placing genuine orders.

Use of the website in a manner that may harm the Seller, other users, or third parties is prohibited.

The User undertakes not to transmit false, incomplete, inaccurate, abusive, or illegal information through the website, or information that may affect the operation of the website.

The Seller reserves the right to restrict a User's access to the website or to certain features thereof in the event of abusive, fraudulent, or contrary use of this document.

  1. Products

The products displayed on the website are intended for personal use, except where otherwise expressly agreed between the parties.

Product descriptions are provided for informational purposes. Product images are for presentation purposes, and minor differences in packaging, color, appearance, or presentation may exist depending on the batch, lighting, screen settings, or updates made by the manufacturer.

The Seller makes every effort to ensure that the information displayed on the website is correct, up-to-date, and complete. However, technical, display, price, stock, or description errors may occur, which will be corrected as soon as possible after identification.

Product availability is displayed subject to existing stock. Placing an order does not automatically guarantee product availability until the order is confirmed.

  1. Ordering Process

The Customer may place an order by adding products to the cart and completing the ordering process by selecting one of the available payment methods.

Placing the order constitutes a purchase offer submitted by the Customer to the Seller.

The automated message sent after placing the order exclusively confirms its registration in the system and does not represent the Seller's final acceptance of the order.

Before accepting and shipping the order, the Seller may contact the Customer to verify the information provided, confirm the order, or clarify the delivery and payment terms.

The sales contract is considered concluded at the moment the Seller confirms the acceptance and shipping of the order.

In the event that a Customer has had three consecutive orders not collected or refused upon delivery within a three-month period for reasons attributable to them, the Seller reserves the right to refuse the processing of subsequent cash-on-delivery orders or to condition their processing on full advance payment.

The Customer will be informed before the order is canceled or the payment method is modified.

Orders that are not delivered or are returned due to reasons attributable to the Seller or the courier company will not be considered, including, but not limited to: shipping the wrong product, damage to the package, errors regarding the delivery address, or delivery failure caused by the courier.

  1. Price or availability errors

In the event of an obvious price error, a technical error regarding product availability, or a display error, the Seller reserves the right to cancel the order, informing the Customer and fully refunding the amounts paid, if payment has already been made.

An obvious price error may include, but is not limited to, the display of a sale price that is disproportionate to the usual value of the product or to the price charged for similar products.

  1. Prices and payment

The prices displayed on the website are expressed in lei and include VAT, in accordance with applicable legislation.

Delivery costs are displayed separately before completing the order, on the checkout page.

Payment may be made online by card, cash on delivery, or through other methods available on the website at the time of placing the order.

The Seller reserves the right to modify product prices, promotional campaigns, discounts, and commercial terms without prior notice. Modifications do not affect already confirmed orders, except in cases of obvious price errors.

Promotions, discount codes, and commercial benefits cannot be combined unless expressly stated on the website or in the respective campaign.

  1. Delivery

Delivery is carried out through express courier services to the address indicated by the Customer at the time of placing the order.

Orders are generally processed within 1 business day of placement, from Monday to Friday.

After the package is handed over to the courier, the estimated delivery time is 1–2 business days.

The total estimated delivery time is 2–3 business days from placing the order, not exceeding the legal term of 30 calendar days from the conclusion of the contract, unless the parties have agreed otherwise.

Products are considered delivered at the moment they are handed over to the Customer or a person designated by them, other than the carrier, at the address indicated in the order.

In the event that delivery cannot be carried out for reasons attributable to the Customer, including providing an incorrect or incomplete address, the Customer's absence from the indicated address, the unjustified refusal of the package, or the inability to contact the Customer, the package may be returned to the Seller. Any additional costs generated by a new shipment may be borne by the Customer.

  1. Order cancellation before shipping

For orders placed online, the Customer may request the cancellation of the order before it is shipped, provided that the order has not already been processed and handed over to the courier.

Cancellation may be requested through the electronic function available in the customer account, on the order page, or by contacting the Seller at contact@atelierrebul.ro.

In the event that the order has already been shipped, the Customer may exercise their legal right of withdrawal in accordance with the Product Return and Exercise of the Right of Withdrawal Policy.

  1. Right of withdrawal

The natural person consumer benefits from the legal right to withdraw from the contract within 14 calendar days, without the need to state a reason, in accordance with OUG no. 34/2014 on consumer rights.

The withdrawal period begins on the day the Consumer or a third party designated by them, other than the carrier, takes physical possession of the products.

In the event that an order contains multiple products delivered separately, the withdrawal period begins on the day the Consumer or the third party designated by them takes physical possession of the last product.

For orders placed online, the Consumer may exercise the right of withdrawal through the electronic withdrawal function available on the website, by accessing the “Right of Withdrawal” link in the website footer or the order page in the customer account.

The Consumer may also submit the withdrawal request by email to contact@atelierrebul.ro or through any other clear and unambiguous statement expressing their decision to withdraw from the contract.

The electronic withdrawal function allows the online submission of the withdrawal request from the contract. Within this flow, the Consumer may be asked to confirm the request through a separate confirmation step, clearly formulated and free of ambiguity.

After submitting the request through the electronic withdrawal function, the Consumer will receive, without unjustified delays, a confirmation of receipt on a durable medium, usually by email. The confirmation will include the content of the withdrawal request, as well as the date and time of its submission.

  1. Cosmetic products, sealed products, and hygiene

In accordance with applicable legislation, the right of withdrawal does not apply to the supply of sealed products that cannot be returned for health protection or hygiene reasons and which have been unsealed by the Consumer after delivery.

This category may include, but is not limited to:

  • cosmetic products;

  • perfumes;

  • creams;

  • shower gels;

  • personal care products;

  • products intended for application on the skin, hair, or body.

Products delivered sealed, which have been unsealed by the Consumer after delivery and cannot be returned for hygiene or health protection reasons, cannot be subject to the right of withdrawal.

Products returned sealed, without traces of unsealing, use, or damage, may be subject to the right of withdrawal, in compliance with the conditions provided in the Product Return and Exercise of the Right of Withdrawal Policy.

  1. Refunds

In the event of a lawful exercise of the right of withdrawal, the Seller will refund the amounts paid for the returned products, without unjustified delays and, in any case, no later than 14 calendar days from the date they are informed of the withdrawal decision.

In the event of withdrawal from the entire order, the refund will also include standard delivery costs, if they were paid by the Customer. The Seller is not obliged to refund additional costs resulting from the Customer's choice of a delivery method other than the standard delivery offered by the Seller.

The Seller reserves the right to delay the refund until the date the returned products are received or until receipt of proof of their shipment, whichever occurs first.

The refund will be made using the same payment method used for the initial transaction, except where the Customer has expressly agreed to another refund method.

  1. Transfer of risk and ownership

The risk of loss or damage to the products is transferred to the Customer at the moment they or a third party designated by them, other than the carrier, takes physical possession of the products.

The right of ownership of the products is transferred to the Customer after full payment of them, subject to order confirmation and delivery of the products.

  1. Limitation of liability

The Seller is not liable for the improper use of the products, for failure to follow the instructions for use, or for indirect damages resulting from their use.

The Customer has the obligation to use the products according to their intended purpose, the instructions for use, the warnings on the packaging, and the information provided by the manufacturer.

The Seller is not liable for delays, errors, or inability to perform obligations caused by events beyond its control, including, but not limited to, technical problems, interruptions of third-party provider services, courier delays, force majeure events, or acts of God.

  1. Customer account

The Customer may create an account on the website to access order history, information regarding placed orders, and other available features.

The Customer is responsible for maintaining the confidentiality of their account access data and for all activities carried out through the account.

In the event that the Customer suspects unauthorized use of their account, they must inform the Seller as soon as possible.

  1. Electronic communications

By using the website, creating an account, or placing an order, the Customer agrees to receive electronic communications necessary for processing the order, executing the contract, delivery, cancellation, return, withdrawal, refund, or other administrative aspects related to placed orders.

Commercial communications, such as newsletters or promotional campaigns, will be sent only under the conditions provided by applicable legislation and the Privacy Policy.

Order confirmations, cancellation requests, withdrawal or return requests, and other operational communications may be sent by email or through other available electronic means.

  1. Personal data protection

The processing of Users' and Customers' personal data is carried out in accordance with the Privacy Policy available on the website.

By using the website and placing orders, the Customer confirms that they have taken note of the information regarding the processing of personal data.

  1. Cookie Policy

The website uses cookies and similar technologies, in accordance with the Cookie Policy available on the website.

Users can manage cookie preferences through the tools available on the website or through the settings of the browser used.

  1. Complaints and dispute resolution

For any complaints or grievances regarding products, orders, delivery, returns, or the use of the website, the Customer may contact the Seller at contact@atelierrebul.ro.

The Seller will review the complaint and respond within a reasonable timeframe, depending on the nature of the request.

In the event that a dispute cannot be resolved amicably, the Consumer may approach the competent consumer protection authorities or competent courts, in accordance with applicable legislation.

This document is governed by Romanian law.

Disputes between the Seller and Customers will be resolved amicably or, if this is not possible, by the competent courts in Romania, in accordance with applicable legislation.
